In March 2011, a tenant of 11740 San Vicente Boulevard in Los Angeles called Wanton Group BTWD LLC filed suit against Douglas Emmett 2002 LLC and Douglas Emmett Management LLC in Los Angeles court claiming that Douglas Emmett had overcharged it with inappropriate fees totaling $183,222 since 2006, in violation of the lease agreement.

Complaint narrative

In March 2011, a tenant of 11740 San Vicente Boulevard in Los Angeles called Wanton Group BTWD LLC filed suit against Douglas Emmett 2002 LLC in Los Angeles court.

Wanton Group BTWD LLC operates a restaurant inside Douglas Emmett’s 11740 San Vicente property. Wanton Group claimed in the court case that Douglas Emmett had overcharged it with inappropriate fees totaling $183,222 since 2006, in violation of the lease agreement.

The inappropriate fees included overcharges for the maintenance of building common areas as well as charges for management and the salaries of building staff. Wanton Group alleged that Douglas Emmett refused to explain these latter fees which were not required per the lease.

Wanton Group claims it was obliged to pay the excessive charges because Douglas Emmett threatened to bring an eviction action if the money was not paid.

After a series of procedural moves by Douglas Emmett, the parties agreed to settle and dismiss the case on undisclosed terms in January 2012.
